Wahlordnung des German Reproducibility Networks

§ 1 Geltungsbereich

Diese Wahlordnung gilt für die Wahlen der Steuerungsgruppe des German Reproducibility Networks.

§ 2 Wahlrechtsgrundsätze

Die zu wählenden Personen werden nach Maßgabe dieser Wahlordnung in gleicher, freier und geheimer Wahl nach den Grundsätzen der Mehrheitswahl unmittelbar gewählt.

§ 3 Wahlberechtigung und Wählbarkeit

(1) ¹Wahlberechtigt sind alle Mitgliedsorganisationen des German Reproducibility Networks nach Annex 2 der Terms of Reference. ²Das Wahlrecht wird jeweils durch eine von den Mitgliedsorganisationen benannte Person ausgeübt.
(2) Wählbar sind alle Personen, die einer Mitgliedsorganisation des German Reproducibility Networks angehören.

§ 4 Amtszeit

(1) ¹Die Amtszeit der Mitglieder der Steuerungsgruppe beträgt drei Jahre ab dem Zeitpunkt der Wahl. ²Mitglieder können einmal wiedergewählt werden und somit maximal 6 Jahre der Steuerungsgruppe angehören.
(2) Die Amtszeit von Mitgliedern der Steuerungsgruppe, die durch Nachwahl nach §13 Abs. 2 oder durch Entsendung nach §13 Abs. 3 ins Amt gekommen sind, läuft abweichend von Abs. 1 nur bis zum nächsten Wahltermin.

§ 5 Wahltermin

(1) Die Wahl findet im zweiten Quartal eines jeweiligen Jahres statt.
(2) Den genauen Wahltermin legt die Steuerungsgruppe fest und teilt diesen einen Monat im Voraus den Mitgliedsorganisationen mit.

§ 6 Bewerbungen

(1) Bewerbungen müssen den Mitgliedsorganisationen spätestens sieben Tage vor der Wahl in Textform zugegangen sein.
(2) ¹Pro Mitgliedsorganisation darf jeweils nur eine Bewerbung eingehen. ²Zwei Personen aus einer Mitgliedsorganisation können eine gemeinsame Team-Bewerbung für einen Sitz in der Steuerungsgruppe (“geteilter Sitz”) einreichen.
(3) In der Bewerbung sollen sich Kandidierende vorstellen und die Motivation für ihre Bewerbung darlegen.

§ 7 Durchführung der Wahl

(1) ¹Jede Mitgliedsorganisation hat so viele Stimmen, wie Sitze in der Steuerungsgruppe zu vergeben sind. ²Sie kann Kandidierenden jeweils eine Stimme geben; Stimmhäufelung ist ausgeschlossen. ³Vergibt die Mitgliedsorganisation weniger Stimmen als ihr insgesamt zustehen, verzichtet sie auf ihre weiteren Stimmen.
(2) ¹Die Wahl kann über eine elektronisches Abstimmungssystem durchgeführt werden. ²Die Einhaltung der Wahlrechtsgrundsätze nach § 2 ist sicherzustellen.

§ 8 Wahlergebnis

(1) Die Wahl ist gültig, wenn mindestens die Hälfte aller Mitgliedsorganisationen an der Wahl teilgenommen hat.
(2) Gewählt sind die Personen, die in der Anzahl der zu vergebenden Sitze die höchste Stimmenzahl und mehr als die Hälfte der abgegebenen Stimmen erhalten.
(3) ¹Ist wegen Stimmengleichheit unklar, wer nach Abs. 2 gewählt ist, so entscheidet das von einem Mitglied des Wahlausschusses zu ziehende Los zwischen den stimmengleichen Kandidierenden.
(4) ¹Personen, die nach Abs. 2 nicht gewählt worden sind, aber mindestens die Hälfte der abgegebenen Stimmen erhalten haben, werden auf einer Nachwahlliste geführt. ²Die Reihung der Personen ergibt sich aus der Anzahl der erhaltenen Stimmen in absteigender Reihenfolge.
(5) ¹Gewählte Personen können innerhalb von sieben Tagen per Textform gegenüber der Steuerungsgruppe erklären, dass sie die Wahl nicht annehmen. ²Nach Verstreichen dieser Frist gilt die Wahl als angenommen.

§ 9 Wahlausschuss

(1) ¹Die Steuerungsgruppe bestellt für die jeweils nach dieser Wahlordnung durchzuführenden Wahlen einen Wahlausschuss. ²Der Wahlausschuss besteht aus drei Mitgliedern der Steuerungsgruppe, die in der durchzuführenden Wahl nicht mehr kandidieren.
(2) Der Wahlausschuss ist für die ordnungsgemäße Durchführung der Wahlen sowie für weitere ihm durch diese Wahlordnung übertragenen Aufgaben verantwortlich.
(3) Der Wahlausschuss ist zur unparteiischen und gewissenhaften Erfüllung seiner Aufgaben verpflichtet.

§ 10 Wahlprüfung

(1) ¹Jede Mitgliedsorganisation kann nach der Feststellung und Bekanntgabe des Wahlergebnisses die Wahl innerhalb von sieben Tagen unter Angabe von Gründen anfechten. ²Die Anfechtung ist an den Wahlausschuss zu richten.
(2) Die Anfechtung ist begründet, wenn wesentliche Vorschriften über das Wahlrecht, die Wählbarkeit oder das Wahlverfahren verletzt worden sind und diese Verletzung zu einem fehlerhaften Wahlergebnis geführt hat oder hätte führen können.
(3) ¹Über die Anfechtung entscheidet der Wahlausschuss durch Beschluss. ²Der Beschluss ist zu begründen und den Mitgliedsorganisationen unverzüglich in Textform zuzustellen. ³Soweit die Anfechtung begründet ist, erklärt der Wahlausschuss die Wahl im erforderlichen Umfang für ungültig. ⁴Soweit die Wahl für ungültig erklärt wurde, wird sie wiederholt. ⁵Die Wiederholungswahl wird unverzüglich, spätestens aber innerhalb eines Monats nach dem Beschluss nach Satz 1, durchgeführt. ⁶Zur Wiederholungswahl sind nur die Kandidierenden zugelassen, die zu der für ungültig erklärten Wahl zugelassen waren.

§ 11 Abwahl

(1) Gewählte Personen können mit einer Mehrheit von zwei Drittel der Mitgliedsorganisationen des German Reproducibility Networks aus wichtigem Grund in einer geheimen Abstimmung abgewählt werden.
(2) Anträge zur Abwahl sind an die Kontaktadresse der Steuerungsgruppe zu richten, welche daraufhin die erforderlichen organisatorischen Maßnahmen ergreift.
(3) Die Abstimmung muss innerhalb eines Monats ab Eingang des Antrags durchgeführt werden.

§ 12 Rücktritt

(1) ¹Ein Rücktritt aus der Steuerungsgruppe ist jederzeit ohne Angabe von Gründen möglich. ²Der Rücktritt ist schriftlich an die Steuerungsgruppe zu richten und erlangt durch Kenntnisnahme Gültigkeit.
(2) Jedes Jahr sollen ein Drittel der Mitglieder der Steuerungsgruppe ausscheiden.

§ 13 Nachbesetzung

(1) ¹Vakant gewordene Sitze in der Steuerungsgruppe können durch die Nachwahlliste nach §8 Absatz 4 oder Entsendung nachbesetzt werden. ²Dabei ist die Nachwahlliste prioritär zur Entsendung zu behandeln. ³Eine Nachbesetzung findet nur statt, wenn zwischen dem Eintritt der Vakanz und dem nächsten regulären Wahltermin mehr als zwei Monate Zeit liegen.
(2) ¹Wird oder werden ein oder mehrere Sitze in der Steuerungsgruppe durch Rücktritt frei, rücken Personen aus der Nachwahlliste entsprechend ihrer Platzierung als neue Mitglieder der Steuerungsgruppe nach. ²Die so ausgewählten Personen können innerhalb von sieben Tagen per Textform gegenüber der Steuerungsgruppe erklären, dass sie auf ihre Nachwahl verzichten. ³Nach Verstreichen dieser Frist, gilt die Nachwahl als angenommen.
(3) Enthält die Nachwahlliste keine Personen oder verzichten alle dort gelisteten Personen auf ihre Nachwahl, so kann die Mitgliedsorganisation, aus der das zurückgetretene Mitglied der Steuerungsgruppe stammt, eine Person aus ihrer Mitte als neues Mitglied in die Steuerungsgruppe entsenden.

§ 14 Inkrafttreten

Diese Wahlordnung tritt mit Beschlussfassung durch die Steuerungsgruppe am 15.03.23 in Kraft.

§ 1 Scope of Application

These election regulations apply to elections of the Steering Group of the German Reproducibility Network.

§ 2 Principles of electoral law

The persons to be elected are directly elected in accordance with these election regulations in an equal, free and secret election according to the principles of majority voting.

§ 3 Eligibility to vote and eligibility to stand for elections

(1) ¹All member organizations of the German Reproducibility Network are eligible to vote according to Annex 2 of the Terms of Reference. ²The right to vote is exercised by one person designated by the member organization.
(2) All individuals who belong to a member organization of the German Reproducibility Network are eligible to stand for elections.

§ 4 Term of office

(1) ¹The term of office of the members of the steering group is three years from the date of election. ²Members can be re-elected once and thus belong to the Steering Group for a maximum of 6 years.
(2) The term of office of members of the Steering Group who have taken office via the succession list in accordance with §13 (2) or via delegation in accordance with §13 (3) shall, notwithstanding clause 1, run only until the next election date.

§ 5 Election date

(1) The election takes place in the second quarter of each year.
(2) The exact election date is determined by the Steering Group and communicated to the member organizations at least one month before the election.

§ 6 Applications

(1) Applications must be received by the member organizations in writing at least seven days before the election.
(2) ¹Only one application may be submitted per member organization. ²Two individuals from one member organization may submit a joint team application for one seat in the Steering Group (“shared seats”).
(3) In the application candidates should introduce themselves and explain the reasons for their application.

§ 7 Conduct of the election

(1) ¹Each member organization has as many votes as there are seats to be allocated in the Steering Group. ²It may allocate one vote to each candidate; accumulation of votes is ruled out. ³If the member organization allocates fewer votes than it is entitled to in total, it shall waive its further votes.
(2) ¹The election may be conducted using an electronic voting system. ²Compliance with the principles of the election in accordance with § 2 must be guaranteed.

§ 8 Election results

(1) The election is valid if at least half of all member organizations have participated in the election.
(2) Based on the number of seats to be allocated the individuals who receive the highest number of votes and more than half of the votes cast shall be elected.
(3) ¹Only one ballot shall be held. ²If, due to a tie, it is unclear who has been elected in accordance with clause 2, a member of the election committee will draw lots to decide the tie.
(4) ¹Individuals who receive more than half of the votes cast but who have nevertheless not been elected in accordance with clause 2 shall be included on a succession list. ²The ranking of the individuals shall be based on the number of votes received in descending order.
(5) ¹Elected individuals can inform the Steering Group in writing within seven days that they do not wish to take up their seat. ²On expiry of this period, elected individuals shall be deemed to have accepted the election result.

§ 9 Election committee

(1) ¹The Steering Group shall appoint an election committee for the elections to be held in accordance with these election regulations. ²The election committee consists of three members of the Steering Group who are no longer standing as candidates in the election to be held.
(2) The election committee is responsible for the proper conduct of the elections as well as for other tasks assigned to it by these election regulations.
(3) The Election Committee is obliged to perform its duties impartially and conscientiously.

§ 10 Election audit

(1) ¹Any member organization may appeal against the election result within seven days after the election result has been determined and announced, giving reasons. ²The appeal shall be addressed to the Election committee.
(2) The appeal is justified if the election regulations have been violated and this violation has led or could have led to an erroneous election result.
(3) ¹The Election committee decides on the appeal. ²Reasons for the decision shall be sent to the member organizations in writing without delay. ³Insofar as the appeal is justified, the Election committee shall declare the election invalid. ⁴If the election has been declared invalid, it shall be repeated. ⁵The repeat election shall be held without delay, but at the latest within one month of the decision on the appeal. ⁶Only candidates who stood in the election that was declared invalid are allowed to stand again in the repeat election.

§ 11 Voting out

(1) Elected individuals can be voted out of office by a majority of two thirds of the member organizations of the German Reproducibility Network for important reasons in a secret ballot.
(2) Motions for voting out must be sent to the contact address of the Steering Group, which will then take the necessary measures to organize the deselection procedure.
(3) The vote must be held within one month of receipt of the motion.

§ 12 Resignation

(1) ¹Resignation from the Steering Group is possible at any time without giving reasons. ²The resignation must be submitted in writing to the Steering Group and becomes valid upon receipt.
(2) Each year, one third of the members shall resign from the Steering Group before the election.

§ 13 Succession rules

(1) ¹If one or more seats in the Steering Group become vacant as a result of resignation according to §12 (1), they may be filled by the succession list according to §8 (4) or by delegation. ²The succession list shall be given priority over delegation. ³Seats will only be filled if there are more than two months between a seat becoming vacant and the next regular election date.
(2)¹Individuals from the succession list shall fill vacancies on the Steering Group in accordance with their ranking on the succession list. ²Individuals selected in this way can inform the Steering Group in writing within seven days that they do not wish to take up their seat. ³On expiry of this period, individuals shall be deemed to have accepted their seat.
(3) If the succession list does not contain any individuals or if all individuals listed there waive their right to take up their seat, the member organization from which the member of the Steering Group who resigned originates may delegate an individual from among its members as a new member to the Steering Group.

§ 14 Entry into force

These election regulations come into force with the adoption by the Steering Group on 15 March 2023.
